Legal news and practices in Russia09.08.2019 A Sakhalin company sent over 6 million rubles to China for undelivered goods
A violation of currency legislation by a cement company was revealed by the Sakhalin Customs. The company transferred 6.2 million rubles to the accounts of foreign suppliers under various contracts for goods that it did not receive.
The Sakhalin company entered into contracts for the supply of equipment, construction and consumables for a cement plant in 2014 with Chinese counterparts.
Inspection of compliance with currency legislation by the Sakhalin customs showed that the goods were not delivered to the customer, while the customer transferred the funds to the suppliers\' accounts. Under 3 contracts, the amount of transfers amounted to 6.2 million rubles.
Concerning the company and its General Director, administrative cases have been instituted on the facts of non-fulfillment by the resident of the obligation to return to the Russian Federation the money paid to non-residents for goods not imported into the Russian Federation, the liability for which is provided for in Part 5 of Art. 15.25 of Administrative Code of the Russian Federation. The firm runs the risk of paying a fine of up to one amount (100%) of money not returned to the Russian Federation.
